Relay EMS Terms of Service
The following terms, conditions, and exclusions shall govern the provision of the Relay EMS Emergency Panic Button App (“Service”) in terms of (“The Agreement”) between Relay EMS and (“Users”).
- Acceptance of terms: By downloading, accessing or using our Services, Users agree to accept these terms of use. If you do not agree, then unfortunately our Services will not be available to the User.
- Eligibility: The Service is available only to validated Users, who have downloaded and activated the Relay EMS App.
- Purpose: The sole purpose of the Service is to provide emergency medical assistance by sending an ambulance to the User’s location upon activation of the panic button.
- Response Time: Arrival times vary based on the incident’s proximity to the nearest response unit and other factors, such as traffic conditions.
- Rural Areas: Service response time in rural areas cannot be guaranteed and is done on a best-effort basis. Arrival times vary based on the incident’s proximity to the nearest response unit and other factors, like traffic conditions.
- Service Activation: In case of a medical emergency, the User can activate the Service by pressing the panic button in the Relay EMS App on their mobile device.
- Location and Data Connection: The app requires access to the User’s location from their phone and a data connection, which is critical to render the Services. By using the App, Users consent to the collection, use and sharing of the User’s location and as such, must allow the app permission to share their location.
- Contact and Dispatch: Based on the information received from the App, Relay EMS will contact the User and dispatch an ambulance to their location.
- No Subscription Fees: The Service has no subscription or membership fees.
- No Roadside Assistance: The Service does not include roadside assistance for vehicle breakdowns.
- User responsibilities: The User herewith agrees that they will provide accurate information for the purpose of providing timely medical emergency response and agree to only use the Services for reasonable medical emergencies and may not use it for false, misuse or unlawful reasons.
- Amendments: Relay EMS reserves the right to amend these Terms of Service from time to time. Continued use of the app after changes indicates acceptance of the revised terms and will be binding on the Users.
- No Guarantees: Relay EMS cannot guarantee safety or prevention of loss, liability, injury, or damage. While care is exercised in rendering the Service, no guarantee or assurance of safety or prevention against loss, liability, injury, or damage is provided.
- Liability: Relay EMS shall not be liable for any consequential, direct, or indirect damages or for any damages incurred by the user in any way associated with the Service. This includes any loss or damage sustained by the User as a result of the failure to render the Service timeously or at all or from any other cause, including negligence, omission, and willful default.
- No Warranties: Relay EMS makes no warranties of any nature and accepts no responsibility or liability for any claims, loss, or damage arising out of or in connection with the supply of the Service.
- Service Abuse: Relay EMS reserves the right to cancel a User’s access to the Service if it becomes apparent that the User is fraudulently abusing the Service or using the Service benefits.
- Privacy and Data Use: We prioritise your privacy, and data will be handled in accordance with our Privacy Policy (link: ) which outlines how your personal information and location data are collected, used and protected.
