This End-User License Agreement (“Agreement”) is a legal agreement between you (“User”, “You”, or “Your”), RRZ Innovations and Relay EMS (“We”, “Us”, or “Our”) regarding your use of the Relay EMS Emergency Panic Button App (the “App” or “Service”).
By downloading, installing, or using the App, or by agreeing to the Terms & Conditions checkbox during registration or login, you confirm that you have read and understood this Agreement and provide your consent to the collection and use of your personal and location data as outlined herein. If you do not agree, you must not use the App.
1. License Grant
RRZ Innovations and Relay EMS grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use and only as permitted by this Agreement.
2. Purpose of the App
The sole purpose of the Relay EMS App is to provide emergency medical assistance by enabling users to request help by pressing an in-app panic button, which alerts and dispatches the nearest available ambulance to your live location. These emergency services may include advanced life support, basic life support, trauma care, and emergency transportation.
3. Location-Based Services
3.1 Consent to Use Location
By using the App and by agreeing to this Agreement, you provide your explicit consent for the App to access your real-time device location. This consent is collected during registration/login and is required for the App to function as intended.
Access to your device’s location enables us to accurately detect your whereabouts and dispatch emergency response services directly to your location when the panic button is activated.
The use of your location data is essential to reducing response time and improving outcomes in life-threatening emergencies.
3.2 Location Sharing
Your real-time location will be:
- Used solely by RRZ Innovations and Relay EMS and its designated response crew to locate you quickly and efficiently for the purpose of rendering emergency medical services.
- Not shared with any third parties for advertising, analytics, or marketing purposes.
The only exception to third-party sharing is if a secondary EMS provider is needed. In such cases:
- You will be asked to explicitly consent to sharing your location with that provider.
- Your consent will be securely recorded before any information is shared.
Disabling location services may result in the App not functioning as intended, and RRZ Innovations and Relay EMS may not be able to dispatch emergency assistance.
4. User Responsibilities
You agree to:
- Provide accurate and truthful information during emergency activations.
- Only use the App in real medical emergencies.
- Not misuse the Service for false alarms, pranks, or unlawful purposes.
RRZ Innovations and Relay EMS reserves the right to terminate access for misuse or abuse.
5. Data Usage & Privacy
We prioritize your privacy. All personal and location data are collected and used solely to facilitate the delivery of emergency services and are managed according to our Privacy Policy. No personal information will be sold or shared outside of service delivery.
6. Limitations of Service
- Service Coverage: RRZ Innovations and Relay EMS services are available only within designated service areas. There may be locations where the Service is not available.
- Outside Service Areas: In the event that you are located outside of our active service areas, RRZ Innovations and Relay EMS may, on a best-effort basis, attempt to divert your request to another EMS provider outside of the app. This diversion is not guaranteed and may be subject to external provider availability and capability.
- Rural Areas: Response time in rural areas may vary significantly and cannot be guaranteed.
- Connectivity Requirements: A working internet connection and active location permissions are required for the Service to function correctly.
- Non-Inclusive Services: The App does not include roadside vehicle assistance or general emergency services unrelated to medical incidents.
7. No Subscription Fees
The Relay EMS App is free to use. No subscription or membership fees apply for access to emergency services.
8. Limitation of Liability
RRZ Innovations and Relay EMS is not liable for:
- Delays or inability to dispatch a response due to location errors, technical faults, or user error.
- Any direct, indirect, or consequential damages arising from the use or inability to use the Service.
- Situations where alternative EMS providers (outside of the app) do not respond or are unavailable.
9. No Warranties
The App is provided “as is” without warranties of any kind. We make no guarantees regarding response time, successful outcomes, or uninterrupted service.
10. Modifications to Terms
RRZ Innovations and Relay EMS reserves the right to modify this Agreement at any time without prior notice. It is your responsibility to review the current version of the Agreement regularly. Continued use of the App after any changes have been made constitutes your acceptance of the modified terms.
11. Termination
We reserve the right to suspend or terminate access to the App at any time without notice for violations of this Agreement.
12. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of South African courts for any dispute arising out of or in connection with this Agreement.
