These Terms and Conditions govern participation in any event, competition, promotion, tournament, giveaway, campaign, or similar activity (“Event”) organised, hosted, administered, promoted, or conducted by Relay EMS Pty Ltd (hereinafter “Relay EMS”).
By registering for, entering, participating in, attending, or otherwise engaging with any Event, participants understand and agree to be bound by these Terms and Conditions.
ELIGIBILITY
Participation in an Event is open only to persons who satisfy the eligibility requirements specified for that Event. Relay EMS reserves the right to verify the eligibility of any participant and may require proof of identity, age, residence, qualification, or any other information deemed necessary. Relay EMS may refuse entry or disqualify any participant who fails to meet the eligibility requirements or who provides false, misleading, incorrect or incomplete information.
REGISTRATION AND ENTRY
Participants must complete all registration and entry requirements as prescribed by Relay EMS. Relay EMS reserves the right to reject, suspend, or cancel any registration or entry that does not comply with these Terms and Conditions or the applicable Event rules. Participants are responsible for ensuring that all information submitted to Relay EMS is accurate and up to date.
FEES AND PAYMENTS
Where an Event requires payment of an entry fee or registration fee, such fee must be paid in accordance with the instructions provided by Relay EMS. Unless otherwise stated, all fees paid are non-refundable. Relay EMS reserves the right to cancel a participant’s registration if payment is not received by the applicable deadline.
PARTICIPANT CONDUCT
Participants shall conduct themselves in a lawful, respectful, and sportsmanlike manner at all times. Relay EMS reserves the right to remove, suspend, or disqualify any participant whose conduct is considered inappropriate, fraudulent, dishonest, abusive, offensive, or otherwise contrary to the spirit of the Event.
EVENT CHANGES AND CANCELLATIONS
Relay EMS reserves the right to amend, postpone, suspend, cancel, or discontinue any Event at any time and for any reason. Relay EMS shall not be liable for any loss, damage, cost, or expense incurred by any participant as a result of such amendment, postponement, suspension, or cancellation.
INTELLECTUAL PROPERTY
All intellectual property rights relating to an Event, including trademarks, logos, content, materials, photographs, videos, graphics, and promotional materials, shall remain the property of Relay EMS or its licensors. Where an Event requires payment of an entry fee or registration fee, such fee must be paid in accordance with the instructions provided by Relay EMS. Unless otherwise stated, all fees paid are non-refundable. Relay EMS reserves the right to cancel a participant’s registration if payment is not received by the applicable deadline.
WINNERS, PRIZES AND REWARDS
Winners shall be selected in accordance with the rules applicable to the relevant Event. The decision regarding any Event, winner selection, scoring, judging, ranking, or prize allocation shall be final and binding. Prizes are non-transferable, non-exchangeable, and may not be redeemed for cash. Relay EMS reserves the right to substitute any prize with an alternative prize of equal or greater value. If a winner cannot be contacted, fails to claim a prize, or is found to be ineligible, Relay EMS may withdraw the prize and select an alternative winner. Participants may not use, reproduce, distribute or modify any intellectual property belonging to Relay EMS without prior written consent. Where participants submit content as part of an Event, they grant Relay EMS a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, display, distribute, and promote such content for purposes related to the Event and Relay EMS’s business.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Relay EMS, its directors, officers, employees, agents, contractors, affiliates, sponsors, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to:
a) participation in any Event;
b) attendance at any Event;
c) any prize awarded;
d) any technical failure, interruption, or error;
e) any cancellation, postponement, or modification of an Event; or
f) any loss of data, income, profit, opportunity, or reputation.
Participation in any Event is entirely at the participant’s own risk.
PHOTOGRAPHY AND MEDIA CONSENT
Participants acknowledge and agree that photographs, video recordings, audio recordings, livestreams, and other media may be captured during an Event. By participating in an Event, participants grant Relay EMS the right to use their name, image, likeness, voice, and submitted content for marketing, promotional, publicity, reporting, and commercial purposes without additional compensation, unless prohibited by law or where the participant has expressly indicated that they do not consent to such use.
AMENDMENTS
Relay EMS reserves the right to amend these Terms and Conditions at any time. Updated Terms and Conditions shall become effective upon publication on Relay EMS’s website.
ASSUMPTION OF RISK
Participation in an Event may involve certain risks. Participants voluntarily assume all risks associated with their participation and acknowledge that they participate at their own risk. Participants are responsible for ensuring that they are physically, medically, and otherwise fit to participate where applicable.
INDEMNITY
Participants indemnify and hold harmless Relay EMS, its directors, officers, employees, agents, contractors, affiliates, sponsors, and partners against any claims, losses, liabilities, damages, costs, or expenses arising from:
a) their participation in an Event;
b) their breach of these Terms and Conditions;
c) their violation of any applicable law; or
d) their infringement of any third-party rights.
DATA PROTECTION AND PRIVACY
Relay EMS may collect and process personal information for purposes relating to Event administration, communication, marketing, prize fulfilment, compliance, and related business activities. By participating in an Event, participants consent to the processing of their personal information for the purposes set out herein
DISQUALIFICATION
Relay EMS may disqualify any participant who:
a) breaches these Terms and Conditions;
b) breaches any Event-specific rules;
c) engages in fraud, cheating, manipulation, or misconduct; or
d) acts in a manner that may prejudice the integrity, reputation, or operation of the Event or Relay EMS.
GOVERNING LAW
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
